NOTICE: Prohibited acts in payment activities
Dear our valued Customers,
In order to guarantee the security and effectiveness of the payment system and safeguard the lawful rights and interests of all parties involved, the State Bank of Vietnam (SBV) has implemented a series of legal measures. These include Decree 52/2024/ND-CP, which governs non-cash payments, as well as Circular No. 19/2016/TT-NHNN and Circular 26/2017/TT-NHNN (which amend and supplement certain provisions of Circular No. 19/2016/TT-NHNN) that regulate bank card operations. In particular, it stipulates a number of prohibited acts in payment transactions at the Bank.
NCB aims to comply with the State Bank of Vietnam's regulations and safeguard customers' rights and interests by providing comprehensive information on banned activities linked to payment services. We would like to share extensive information on these acts, as outlined in the aforementioned documents:
1. Providing dishonest information related to the provision or use of payment services, payment intermediary services, including but not limited to the following acts:
a. Providing fake information to register for opening accounts, issuing cards, and registering for electronic banking services;
b. Making, using, transferring, and circulating fake cards;
2. Opening or maintaining anonymous or impersonated payment accounts, e-wallets; buying, selling, renting, leasing, borrowing, lending payment accounts, e-wallets; renting, leasing, buying, selling, opening bank cards (except for anonymous prepaid cards); stealing, colluding to steal, buying, selling payment account information, bank card information, e-wallet information.
3. Issuing, supplying, and using illegal means of payment:
a. Providing intermediary payment services without being granted a License to provide intermediary payment services by the State Bank of Vietnam.
b. Providing payment services without being a payment service provider: The card accepting unit transfers the card accepting device, QR Code to another party for use; accepting card payments without a card payment contract; and illegally using card accepting devices, QR Codes of card payment organizations in Vietnam or abroad.
c. Performing, organizing/facilitating fraudulent and counterfeit transactions; Fake payment transactions at the card accepting unit (without arising from the purchase and sale of goods and provision of services);
d. Repairing, erasing payment means, payment documents not in accordance with the law; counterfeiting payment means, payment documents; storing, circulating, transferring, or using fake payment means.
4. Carrying out, organizing, or facilitating the carrying out of the following acts: using, taking advantage of payment accounts, payment means, payment services, and payment intermediary services to gamble, organize gambling, commit fraud, swindle, conduct illegal business, and commit other illegal acts. Including, but not limited to, the following acts:
a. Using accounts/cards as a means to conduct illegal transactions such as: gambling, betting, fraud, swindling, foreign exchange transactions on websites, money laundering, terrorist financing, and other illegal acts;
b. Taking advantage of international payment cards (Visa ...) to conduct foreign exchange transactions, transfer money between Vietnam and foreign financial institutions for illegal purposes (such as trading forex, securities, virtual currency, gambling, buying goods such as real estate, gold abroad, etc.) and then reselling them for cash; or withdraw cash directly abroad;
5. Erasing, changing the content, buying, selling, transferring, leasing, lending, or forging the License to operate as an intermediary payment service provider.
6. Entrusting or assigning agents to other organizations or individuals to carry out activities permitted under the License to operate as an intermediary payment service provider.
7. Fraudulently or forging documents proving eligibility for a License to operate as an intermediary payment service provider in the application for a License.
8. Operating in a manner inconsistent with the content specified in the License to operate as an intermediary payment service provider.
9. Intruding or attempting to intrude, stealing data, destroying or illegally changing software programs or electronic data used in payment, and taking advantage of computer network system errors for personal gain.
Any acts that show signs of violating the law must be reported to the competent state agency and may be subject to administrative penalties of up to VND 150,000,000 or criminal prosecution and compensation for damages according to the provisions of the law.
NCB reserves the right to refuse to perform, investigate, and refund transactions that violate Vietnamese law. Violating cards/accounts will be permanently closed.
